How we protect and handle your information

This Privacy Policy describes how Prospitality, Inc., a Delaware corporation, ("we," "us," or "our") collects, uses, and shares information in connection with you providing information for our development and improvement of, and/or your use of, our Check My Checks™ service. We are committed to protecting your privacy and handling your personal information responsibly.

1. Information We Collect

We collect the following types of information:

Information You Provide Directly:

Pay Stub Data: You upload your pay stub to us. While we only need your payment details for compliance calculations and to otherwise develop the technology behind Check My Checks (e.g., hours worked, pay rate, deductions related to minimum wage, overtime, spread of hour, and minimum tip make-up), your pay stub may contain other personal, employer, or tax information. Please make certain to redact any information you don't wish to share before uploading.

Communication Data: If you opt-in, we may collect your email address to reach out to you directly for service testing. Any additional information you provide in the "Tell us anything else important" section is also collected.

Automatically Collected Information: Like most online services, we may collect certain information automatically when you access or use the Check My Checks™ service, such as your IP address, browser type, operating system, and usage patterns. This data is primarily used for analytics and to improve our service.

2. How We Use Your Information

We use the information we collect for the following purposes:

To Provide and Improve Check My Checks™: To help us develop, and/or enable you to use, our Check My Checks service, a service designed to quickly double check your pay stub against certain current (2025) New York State employment-related laws, regulations, ordinances, and the like ("Laws") – in particular, those Laws related to the payment of wages and that are applicable to non-exempt hospitality, food service, and fast food workers working in the state of New York.

To conduct research with real-world pay stubs to be able recognize and respond accurately to various commonly-used pay stub formats used by employers or by payroll services on behalf of employers. To explore various compensation records to train our tool to better analyze and flag areas where there might be compliance issues to bring to your employer's attention.

Communication: To communicate with you regarding your use of Check My Checks™ (when it is ready for such usage), provide support, and, if you've consented, invite you to test and use our service directly.

Research and Development: To analyze user behavior, develop new features, and improve the overall functionality and accuracy of Check My Checks™.

Security and Compliance: To detect and prevent fraudulent or unauthorized activity, and to ensure compliance with applicable laws, regulations, and our terms of service.

3. How We Share Your Information

We may share your information with the following categories of third parties:

Third-Party Service Providers: We engage third-party companies and individuals to perform services on our behalf, such as data hosting, AI processing, and analytics. These providers have access to your information only to perform these tasks and are obligated not to disclose or use it for any other purpose.

Research Partners: As part of our research to train and improve our AI tool, uploaded files (after your redaction of sensitive personal details) may be shared with our research collaborators. These partners will be contractually bound to maintain the confidentiality and security of your data and use it only for the stated research purposes.

Legal Compliance and Protection: We may disclose your information if required to do so by law or in response to valid requests by public authorities (e.g., a court order or government agency request). We may also disclose your information to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties.

Business Transfers: In the event of a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred to the acquiring entity.

4. Data Security

We are committed to protecting the private information of New York residents and all users. We implement and maintain reasonable administrative, technical, and physical safeguards to protect the information we collect from unauthorized access, use, disclosure, alteration, or destruction.

These safeguards include, but are not limited to:

• Access controls and authentication procedures

• Regular security assessments and updates

• Training our employees and other personnel on data privacy and security

Despite our efforts, no security system is impenetrable, and we cannot guarantee the absolute security of your information.

5. Data Retention

We retain the information we collect for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law. Once the information is no longer needed, we will securely dispose of it in accordance with our data retention policies.

6. Your Rights and Choices

Subject to applicable law, you may have the following rights regarding your personal information:

Right to Access: You may request access to the personal information we might hold about you.

Right to Correction/Rectification: You may request that we correct any inaccurate or incomplete personal information we might hold about you.

Right to Deletion (Right to Be Forgotten): You may request the deletion of your personal information we might hold about you, subject to certain exceptions (e.g., legal obligations).

Right to Withdraw Consent: If we are processing any of your personal information based on your consent, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.

Opt-out of Communications: You can opt-out of future communications from us by following the unsubscribe instructions in any email you receive or by contacting us directly.

7. Children's Privacy

Check My Checks™ is not intended or permitted for use by individuals under the age of 18. Likewise, if you are under 18, you are prohibited from providing any information to us even if you are currently an employee receiving pay stubs.

To be clear, we do not knowingly collect personal information or paystub data (redacted or not, and, if redacted, regardless of whether such paystub would not qualify as personal information for the purposes of applicable law) from children under 18. If we become aware that we have inadvertently received personal information or paystub data from a child under 18, we will delete such information from our records.

8. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or legal requirements. We will notify you of any material changes by posting the updated policy on our website or through other appropriate communication channels.

Your continued participation in the development of, and/or your use of, Check My Checks™ after the effective date of the revised Privacy Policy constitutes your acceptance of the terms.
